STANDARD TERMS AND CONDITIONS

These terms contain the entire understanding between the "Clients", and Alan Rogers Photography, hereinafter referred to as the "Photographer". Refer also to email/sms communications between the parties as to any exclusions/inclusions and/or special arrangements. A deposit/retainer is due on booking and the balance two weeks prior to the wedding unless otherwise agreed to.

Cooperation: The Clients and the Photographer consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this agreement. The Clients also agree to give the Photographer sufficient warning of key events at the wedding to give the Photographer time to prepare e.g. bouquet throwing, cutting the cake, speeches, dances etc. Please note that not all guests at weddings like having their photo taken. In such cases the Photographer will use his discretion but cannot be held responsible for a lack of photos of these people. In the spirit of cheerful cooperation the Clients agree to give the Photographers precedence over the guests in order to take the photographs required for the wedding services described above. The Photographers cannot be held liable for a lack of wedding photos if guests taking their own photos of the Clients continually interrupt the Photographer's work.

House Rules: Photographers are sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example some ministers insist that no flash photography is allowed, and others will request that the Photographers shoot from a specific location. In such circumstances the Clients agree to accept the technical limitations that may be imposed on the Photographer and equipment used. We advise the Clients to make themselves aware of the rules of the venue concerned and if necessary negotiate with the personnel concerned.

Style: The clients acknowledge that the Photographer requires and retains discretion as to how its services shall be provided (e.g. choice of poses, lighting, lenses, etc.) and are familiar with the Photographers portfolio and is requesting services with knowledge of the Photographers style; that the Photographer’s work is constantly evolving; that the Photographers services are of unique nature; and that in creating the images, the Photographers shall use their personal judgment to create images consistent with their vision of the wedding, which vision may be different from the Clients. Accordingly, the Clients acknowledge that the images shall not be subject to rejection on the basis of taste, esthetic criteria, or personal appearance.

Copyright: As per industry standards the copyright of the images remains with the Photographer. The Photographer grants the Clients permission to make copies under the following conditions. The images taken by the Photographer are for personal use by the Clients and their friends and relatives. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from the Photographer. Model Release: The Clients grant the Photographer and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs for editorial, competition, and advertising purposes, to alter the photographs without restriction; and to copyright the images. The Clients hereby release the Photographer and its legal representatives, heirs and assigns from all liability & claims in connection with the images.

Cancellation: In the event of these Terms and Conditions not being met in part or full, or the Clients canceling the wedding for any unreasonable reason (e.g. change of mind) the retainer/deposit is non-refundable. It will be considered as liquidated damages to help offset the loss of business to the Photographer. The Photographer will work with the Clients to organise another date and time, and may at its discretion hold the retainer/deposit as a credit for a future date to be determined providing the Photographer is not already booked or unavailable for any reason on that date.

Limit of Liability: If the Photographer is too ill, becomes injured, and/or due to circumstances reasonably beyond their control, cannot supply the wedding services as agreed to, the Photographer will make extreme efforts to find a replacement Photographer. If a replacement Photographer can not be organised in time then a FULL refund of ALL payments already received will be made within seven days. The Photographer has working methods in place to prevent loss or damage to images, however, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons beyond the Photographers control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied.

By submitting this booking/agreement form the client has understood the contents and agrees to the terms therein.
